1. Scope of Services

DARK GOLDEN MAVERICK LLC, doing business as e-Maverick, provides B2B email marketing consulting and implementation services for e-commerce and digital brands, including email strategy, audits, copywriting, campaign management, newsletter and blog content, CRM automation, segmentation, and deliverability optimization. Specific services, deliverables, timelines, and fees are established in a written service agreement prior to onboarding.

2. Client Responsibilities & Compliance

By signing our Master Service Agreement, clients legally warrant that all email contacts provided for campaign management have provided explicit, verifiable consent to receive communications, in full compliance with CAN-SPAM, GDPR, and other relevant anti-spam legislation. We do not work with scraped or purchased lists.

3. Acceptable Use Policy & Compliance Audits

DARK GOLDEN MAVERICK LLC provides consulting, implementation, and campaign management services subject to a strict Acceptable Use Policy. Clients are expressly prohibited from utilizing our services or infrastructure to promote restricted categories, including but not limited to unverified health claims, multi-level marketing, or prohibited financial schemes. While clients are solely responsible for the content of their communications, we actively monitor sender reputation and network health. We reserve the right to audit campaign content at any time and will immediately suspend or terminate services if a client is found violating these terms or standard anti-spam legislation.

4. Disclaimer of Warranties & Limitation of Liability

While we implement industry best practices for sender reputation, email deliverability is subject to algorithmic changes by mailbox providers. We do not guarantee specific open rates, revenue generation, or inbox placement metrics. In no event shall DARK GOLDEN MAVERICK LLC be liable for indirect, incidental, or consequential damages, including lost profits, arising from the use of our services.
